2. License
2.1 The Software is licensed, not sold. The Licensor grants the User the rights set out in the MIT License below. The license is free of charge.
2.2 Copyright and all other rights in the Software that aren’t expressly granted remain with the Licensor.
2.3 The Software doesn’t contain any third-party libraries. The colour schemes it offers reproduce the colour values of third-party themes, which are acknowledged in the third-party notices that come with the Software.

Permission is hereby granted, free of charge, to any person obtaining a copy of this software and associated documentation files (the “Software”), to deal in the Software without restriction, including without limitation the rights to use, copy, modify, merge, publish, distribute, sublicense, and/or sell copies of the Software, and to permit persons to whom the Software is furnished to do so, subject to the following conditions:
The above copyright notice and this permission notice shall be included in all copies or substantial portions of the Software.
THE SOFTWARE IS PROVIDED “AS IS”, WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NONINFRINGEMENT. IN NO EVENT SHALL THE AUTHORS OR COPYRIGHT HOLDERS BE LIABLE FOR ANY CLAIM, DAMAGES OR OTHER LIABILITY, WHETHER IN AN ACTION OF CONTRACT, TORT OR OTHERWISE, ARISING FROM, OUT OF OR IN CONNECTION WITH THE SOFTWARE OR THE USE OR OTHER DEALINGS IN THE SOFTWARE.
3. Third-party services
3.1 The Software can connect to services operated by third parties, in particular Google Drive, Discord, Apple iCloud, Apple Calendar and Apple Maps, cloud storage providers such as Dropbox, and the link preview services of Spotify, YouTube and SoundCloud (“Third-Party Services”).
3.2 Third-Party Services aren’t part of the Software. Their use is governed exclusively by the terms and privacy policies of their providers. The User is responsible for having the accounts, access tokens and permissions required for these services, and for complying with their terms.
3.3 The Licensor isn’t affiliated with the providers of Third-Party Services. The Licensor doesn’t guarantee that they’re available or compatible with the Software.
4. Obligations of the User
4.1 The User may use the Software only in accordance with applicable law and with the terms of the Third-Party Services connected to it.
4.2 The User is solely responsible for all content entered into or processed with the Software (“User Content”). This includes personal data of third parties, such as band members or contacts. The User must ensure that processing this data is lawful.
4.3 The Software stores data on the User’s devices and in storage locations chosen by the User. The User is responsible for regular backups of their User Content.
4.4 Details on the processing of personal data are set out in the Privacy Policy.
5. Warranty
5.1 The Software is provided free of charge and “as is”. The Licensor doesn’t warrant that the Software is free of defects, runs without interruption, or is suitable for a particular purpose.
5.2 Since the Software is provided free of charge, the Licensor is liable for defects in title and material defects only if the Licensor fraudulently concealed them (Sections 523 and 524 of the German Civil Code, BGB).
6. Limitation of liability
6.1 The Licensor is liable without limitation for damage caused intentionally or by gross negligence, for injury to life, body or health, and under the German Product Liability Act (Produkthaftungsgesetz).
6.2 Beyond Section 6.1, the Licensor isn’t liable for damage of any kind, in particular not for loss of data or for damage caused by Third-Party Services (Section 521 BGB).
6.3 The above limitations also apply to the personal liability of the Licensor’s representatives and agents.
7. Changes and discontinuation
7.1 The Licensor may change, update or discontinue the Software at any time. The User has no claim to specific features, updates, support or continued availability.
7.2 The Licensor may amend these Terms with effect for the future. The current version is published at this address and shows its effective date. Continued use of a new version of the Software constitutes acceptance of the amended Terms.
8. Governing law and final provisions
8.1 These Terms are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). For consumers, this choice of law applies only insofar as it doesn’t deprive them of the protection of mandatory provisions of the law of the country in which they have their habitual residence.
8.2 If the User is a merchant, a legal entity under public law or a special fund under public law, the place of jurisdiction for all disputes arising from these Terms is Cologne, Germany.
8.3 If any provision of these Terms is or becomes invalid, the validity of the remaining provisions is unaffected.
